Here is a link to the Fuel Tax Evasion Unit of ADOT (Arizona Department of Transportation). Here is the law we are discussing, just so that it is embedded withing this thread. I have bolded the pertinent part of the law.

Fuel-Tax Rates in Arizona

The Arizona tax on gasoline (motor vehicle fuel) is 18¢ per gallon. Use fuel (diesel) is taxed at two rates in Arizona.
If the use fuel is used in the propulsion of a use class motor vehicle on a highway in this state, the tax rate is 26¢ for each gallon.
A "use class motor vehicle" means a motor vehicle that uses use fuel on a highway in this state and that is a road tractor, truck tractor, truck or passenger carrying vehicle having a declared gross vehicle weight of more than 26,000 pounds OR having more than two axles.
If the use fuel is used in the propulsion of a light class motor vehicle (such as a pickup truck) or an exempt vehicle (certain school buses, government and non-profit vehicles, see 28-5432.C) on a highway in this state, the use fuel is taxed at the same rate per gallon as the motor vehicle fuel tax (18¢ per gallon). (See 28-5601, 5605, 5606.)

Does this mean we can only fuel up at a truck stop with the higher rate??
And not at an auto gas /diesel station ??

Well now isn't that interesting.
Guess they don't expect >26,000lb vehicles refueling at Circle-K then?

So they probably won't be monitoring those!

It is really more accurate to say it is a discount for light vehicles, than a penalty for large ones. The higher rate makes taxes pretty comparable with other states, in the middle, not at the high end.

No Bill, you can fuel where you want EXCEPT you are responsible for filling at a pump which is collecting the 26 cent use tax for vehicles which meet the requirements of Arizona use tax code which applies to our coaches (use class motor vehicle). I'll be doing my filling in Arizona at truck stops...my average fill is about 150 gallons and that is only $12 more to avoid the risk of a $1000 fine.

I’m not a lawyer but since it says “passenger carrying vehicle” and not “passenger vehicle” it looks to me like they’re talking about a “passenger carrying vehicle” that requires a CDL with a “passenger endorsement” …. it doesn’t sound like they’re talking about RV’s to me.

But they obviously are talking about RV's because they are writing $1000 tickets to RV owners who are violating the law. Now, could a person go to court and fight the ticket on the basis of your logical argument? Sure, but it won't be me...life is too short.

Another poorly written AZ law! AZ regulation does say tax being charged must be clearly posted at the pump. Wonder which rate or if maybe both rates are being charged at Flying J? Bet their RV pump rates are same as big guy 'commercial' pumps. If not they'd have to post them both on their big signs out front like 'cash/non-cash'. Now I know why FJ diesel is often more than some of the surrounding mom & pop's. Mike, your tax Rate by State chart explains why when going to (or from when possible) NV/CA, it's wise to fuel up on the AZ side.

I've also noticed that the Moapa Paiute Travel Plaza indian reservation station to the NE of Las Vegas is significantly less than ones in Vegas. Are stations on Indian Reservations in NV/AZ exempt from state fuel taxes? If so, that means the Indians are pocketing that money if they charge what a station across the highway and off the reservation, does! And I thought the casinos and smoke shops were the only $$ grabbers the indians have going in AZ!

Hi Neal,

It may be true that they're handing out tickets but there doesn't seem to be hundreds of RV owners reporting on the internet that they have been ticketed. Have you seen a lot of other complaints about $1000 tickets or just the one by the "toterhome" guy that started the discussion?
