I see what you're saying. On the "request a replacement title" form, it doesn't ask for the buyer's name. The way I read it, you can request a replacement title, and then wait to fill in the buyer's name at the time of sale.

Of course, every DMV office I've ever dealt with is a little different. Might help to go in and explain your situation to someone. If you don't get an answer you want, try another DMV office away from a large metropolitan area. I've had success in Virginia walking into a small "country" dmv office and walking out with what I needed rather quickly.

The thing that would bother me as a buyer, is that I've been told by the Florida DMV and by an attorney, that whoever holds the title (if one exists) is considered to be the legal owner, regardless of someone having a Bill of sale, etc. that states otherwise.

That is so true. I had that happen to me when I bought an old car out of a junkyard. It had a current plate and was still titled in the former owners name. I won't tell you what I had to do to get the owner to sign it over to me, but I finally got it. I was a cop then and the laws were different at that time.
This was in the last century, a LONG time ago

Sorry.. guess I'm just spoiled?
I would never purchase a big ticket item without a title. Here in Arizona I have at least 15 titles from quads, off road bikes, motorhomes, cars, sand rails, etc.. These all date back to the 60's too. Some I had to apply for a title as originals were not available and research, lien releases, etc were all checked by the DMV.

Guess I'm just old school but there no need for me to take unnecessary chances, especially as I close in on retirement and static income. If my state didn't title old vehicles I'd title it in one that does.
